SparkleShot Terms of Service 1.0 / 2026-10-17 These terms describe the conditions of using SparkleShot, responsibilities, and your rights. See the Software License for licensing and the Privacy Policy for personal-information handling. 1. Application and acceptance These terms apply to the SparkleShot application and related product support provided by Sparkle. Read them before installation or use; if you do not agree to the applicable terms, stop installation and use. Merely viewing this page or continuing use does not establish any separately required notice, consent, or guardian consent. 2. Provider and eligibility SparkleShot is created and maintained by 唐梓耀 / AdrianSparkle and 丁铭 / EliasSparkle. Use devices you are authorized to operate and have the legal capacity needed to understand and accept these terms. Minors should have guardian guidance. No SparkleShot account is required. 3. Features and requirements The product provides local screenshots, scrolling captures, screen and audio recording, annotation, text recognition, and media editing and export. The current project targets macOS 15 or later. Architecture, formats, and permissions depend on the build and distribution channel actually supplied. System restrictions, protected content, other apps, hardware performance, and available storage can affect features. Product descriptions do not guarantee that every device, window, or audio source can be captured. 4. Distribution, pricing, and store rules Obtain software through trusted channels announced by Sparkle. “Coming to the Mac App Store” describes a planned channel, not an existing listing or a promise of a release date, price, or permanent free availability. For App Store copies, purchases, Family Sharing, refunds, and account rules follow the applicable Apple terms and store listing. Charges require clear disclosure on the actual purchase page. These terms alone do not create a subscription or authorize billing. 5. Recording authorization and acceptable use Ensure you have the right to capture, edit, store, and share the relevant images, audio, and text. Follow applicable law, workplace or school rules, confidentiality duties, and third-party terms. Do not use the product for unauthorized surveillance, privacy violations, credential theft, infringing distribution, harassment, or other unlawful activities. Screen, microphone, or file permission from the operating system is not consent from the recorded person or rights holder. This product provides no permission to bypass DRM, system security, or third-party access restrictions. 6. Your content and results You retain applicable rights in your existing content and lawfully created outputs; use does not transfer those rights to Sparkle. Check recipients, sharing services, and exports, including OCR, redaction, cropping, timelines, audio tracks, and compression. Recognition can be inaccurate. Visual redaction does not erase an original file or every copy. 7. Storage, backups, and deletion Keep independent backups of important material and inspect exports before deleting source media. Write failures, permission changes, interruptions, or insufficient storage can prevent completion. Recent entries, outputs, recovery files, and sharing copies are managed separately. Clearing history or uninstalling is not comprehensive erasure. Confirmed output deletion moves the selected file to the Trash; recovery files are confirmed individually. Check the target and consequences before deleting, overwriting, or sharing. Maintainers cannot remotely recover local files you have not supplied. 8. Support, maintenance, and updates Product feedback is available through public contact channels. Fixes, updates, and support depend on what is actually offered. We do not promise fixed response times, perpetual compatibility, or a fix for every issue; mandatory legal obligations remain. Updates may change formats, requirements, or features. Material changes to use conditions or processing will be explained as appropriate. A general term does not authorize new charges, content uploads, or expanded permissions. 9. Third-party services and open source macOS, the App Store, sharing services, and external websites are provided by their respective operators. SparkleShot uses a separate LAME MP3 encoding library. Its rights and conditions appear in Open-source Licenses, Third-party Notices, and Corresponding Source. A component’s license does not make the entire app open source; these terms do not restrict rights already granted by component licenses. 10. Warranties and responsibility To the extent permitted by law, the product is provided in its available condition without a promise of error-free, uninterrupted operation or suitability for every purpose. Responsibility for issues involving systems, hardware, third-party services, or your modifications is determined by the facts and applicable law. These terms do not exclude non-excludable warranties, consumer remedies, privacy rights, or liability for intentional misconduct, gross negligence, personal injury, or other matters that cannot lawfully be excluded. 11. Discontinuation, disputes, and changes You may stop use or uninstall at any time and separately manage files and backups. Material license violations are addressed in the Software License. Stopping use does not erase accrued legal responsibilities or existing open-source rights. Please contact maintainers to discuss a dispute. This does not prevent recourse to a court or regulator with lawful jurisdiction. These terms preserve mandatory protections where you live, do not require arbitration, and do not waive collective remedies. An invalid provision does not necessarily invalidate independent remaining provisions. Material revisions will be dated and notified as required by law. 12. Contact For privacy questions, rights requests, support, or infringement reports, contact maintainer 唐梓耀 / AdrianSparkle on QQ at 2410710390.
